Cross-border preparation

Malaysia data licensing preparation guide

Prepare a Malaysia-specific section 129 review using current cross-border guidance rather than an outdated transfer template.

Use the current framework

Malaysia’s Personal Data Protection Commissioner publishes cross-border-transfer guidance tied to section 129 of Act 709. The official guidance explains that it supplements the Act and other applicable instruments rather than replacing them. Start the project with a current-law review: record the guidance version, the relevant commencement provisions, and the condition proposed for the transfer. Do not reuse an old checklist simply because a previous cloud-service contract used it.

Describe the destination and receiver

A licensing deal may give the receiver independent rights over training, benchmarking, and model development. Ask the lab to identify its role and all countries in which the data will be accessible. Build a review pack containing the original privacy notice, collection channel, purposes, participant permissions, and sensitive-field inventory. Ask counsel which section 129 condition fits, what assessment evidence is required, and whether sector-specific requirements change the answer.

Keep language quality and rights separate

A multilingual Malaysian corpus can have useful Malay, English, Chinese, Tamil, or mixed-language coverage, but those characteristics should be measured rather than advertised as guaranteed market demand. Prepare sampling notes, transcription conventions, code-switching labels, and evidence of contributor rights. Keep employment or customer-service records outside the evaluation sample until their proposed reuse has been reviewed. If the buyer requests annotations abroad, add that vendor to the transfer analysis instead of treating annotation as an invisible preparation step.

  • Document the exact destination and transfer condition under review.
  • Keep signed contributor terms linked to dataset versions.
  • Describe onward access, deletion, complaints, and security responsibilities.
  • Use the final regulator guidance rather than a consultation draft.

Review before release

Ask qualified local counsel to review the actual dataset, collection history, proposed training purpose, recipient, and current rules before releasing personal data.
