Mexico data licensing preparation guide

Use Mexico’s current private-sector law and reconstruct the notice and transfer permissions behind a dataset.

Check the current legal text

Mexico issued a new Federal Law on Protection of Personal Data Held by Private Parties in March 2025. The Chamber of Deputies hosts the consolidated text, including subsequent amendments. Begin with that current source rather than a legacy summary of the 2010 law. Ask Mexican counsel to confirm the applicable authority, transitional provisions, and requirements for the proposed transaction; older templates may retain obsolete references.

Reconstruct the notice history

A useful preparation exercise is to match each collection period to its privacy notice and supporting permissions. Customer records, survey responses, contributor recordings, and scraped text should not be bundled under one assumed permission. Describe the proposed training and any international disclosure clearly to the reviewer. The business question is whether the lab’s use is supported by the applicable rules and evidence, not merely whether the seller possesses a copy.

Prepare for a Spanish-language diligence review

Keep original Spanish notices and contributor agreements alongside faithful working translations. For a regional-language or Spanish corpus, document geography and language labels without implying that country labels prove representativeness. List copyright sources, participant rights, confidentiality restrictions, and the handling of sensitive information. Ask the buyer for the actual contracting entity, onward recipients, retention schedule, and access locations before giving it a real sample.

  • Verify citations and regulator references against the current consolidated law.
  • Record the precise training purpose and transfer questions needing advice.
  • Use synthetic or carefully cleared examples for the first quality review.
  • Keep contract rights, privacy permissions, and technical quality as separate evidence tracks.

Review before release

Sources reviewed on 19 October 2026. This is a preparation checklist, not legal clearance, tax advice, or confirmation that an AI lab accepts suppliers from this jurisdiction. Ask qualified local counsel to review the actual dataset, collection history, proposed training purpose, recipient, and current rules before releasing personal data.
